  2. [DPO] The Controller has not designated a Data Protection Officer as there is no such legal obligation. Please contact the Controller in matters regarding personal data processing.

  3. [Purpose] Under the consent given by you, the Controller processes your personal data for the Controller’s marketing purposes only, including in particular for the purpose of promoting the services of the Controller (Centrum Psychoterapii HELP), including but not limited to sending offers, a newsletter, information, advertising or promotional materials about goods and services, as well as for the purpose of promotional and marketing events organised by the Controller (Centrum Psychoterapii HELP) and other events organised by the Controller (Centrum Psychoterapii HELP) in relation to the objects of the Controller’s business as well as events of which the Controller (Centrum Psychoterapii HELP) is a participant/partner.

  4. [Recipients] The recipients of the personal data you provided are suppliers of the goods and services necessary to achieve the above-mentioned objectives and the Controller’s legal successors as well as legally authorised entities, including state authorities.

  5. [Retention Period] Your personal data will be stored until you withdraw your consent.

  6. [Rights] You have the right to access, rectify, erase, restrict the processing of, and transfer your personal data. You also have the right to withdraw at any time the consent you gave us, and you may do so by a unilateral declaration; this, however, does not affect the lawfulness of the processing carried out based on the consent before it has been withdrawn. You also have the right to file a complaint with the supervisory authority which is the President of the Personal Data Protection Office in Poland (Prezes Urzędu Ochrony Danych Osobowych).

  7. [Automated Decision-Making] The personal data processed based on your consent are subject to automated processing, including profiling, it will not, however, lead to automated decision-making which produces legal effects concerning you or affects you in a similarly significant way, as referred to in Article 22(1) of the GDPR. This means that your personal data are only used to match our materials to your person, so that you only receive such information that matches your interests.

  8. Provision of data is voluntary.

individuals who declare they wish to use a service by providing their personal data

If you use the platform https://booksy.com or booksy mobile application (hereinafter also referred to jointly as the “Booksy App”), CPHELP refers you to the Data protection rules and regulations available at https://booksy.com/pl-pl/p/privacy and https://booksy.com/pl-pl/p/terms as well as the Data protection rules and regulations available at https://www.cphelp.pl in the Policy, as the applicable rules and regulations. In your case, the data have been transferred to Co-Controllers, i.e. entities who, upon mutual agreements, determine the purposes and manners of Data processing and clearly describe the applicable scopes of their liability regarding the obligations under the GDPR, and these are:
    Booksy International sp. z o. o. with its registered office in Warsaw (02-722), at the address: al. KEN 105 lok. U4, National Court Register number (KRS): 0000515914, tax identification number (NIP): 9512381607 (Booksy), and
    Katarzyna Szostak running a business under the business name “Katarzyna Szostak” with its registered office in Warsaw (03-808) at the address: ul. Mińska 25C lok. 78, tax identification number (NIP): 8512911513, who in an additional fixed establishment runs a centre for psychological and psychotherapeutic assistance “Centrum Psychoterapii HELP” in Warsaw at the addresses: ul. Chmielna 116/118 lok. 102 and ul. Wspólna 50 lok. 10, phone number: 720 826 806, email: kontakt@cphelp.pl.

  3. If you consented to the transfer of your Data to a selected Specialist/psychologist/psychotherapist and you pay for the services directly to this person, in your case, the data have been transferred to Co-Controllers, i.e. entities who, upon mutual agreements, determine the purposes and manners of Data processing and clearly describe the applicable scopes of their liability regarding the obligations under the GDPR, and these are:

    - the selected Specialist/psychologist/psychotherapist to whom CPHELP transferred the Data under your consent.

  5.  [Purpose of Processing and Related Legal Basis] The Controller processes your personal data solely under the law and for specific purposes, i.e.:
    - with regard to standard data processed to render services, including but not limited to the registration of the Patient, establishing, determining the essence, amending or terminating the legal relation between the Patient and CPHELP, making the Patient’s appointment with an appropriate Specialist/psychologist/psychotherapist, providing preventive healthcare: informing the patient whether it is possible to provide a service, provide education materials, provide information about health-oriented events, managing healthcare systems and services: registration of the Patient, providing for treatment continuity, including but not limited to reminding about the date of a healthcare service, appointment confirmation or cancellation, informing about organisational changes at Centrum Psychoterapii HELP affecting the provision of an expected service, accepting and archiving your declarations of intent regarding authorisation of other individuals to access your medical records and informing such other individuals about your health condition:
         - the legal basis of personal data processing, where a service is provided by the Controller or a designated person who acts on behalf of and for the Controller (e.g. under an order for service), is the necessity of the processing to perform a contract (Article 6(1)(b) of the GDPR) and Article 9(2)(h) of the GDPR,
          - the legal basis of personal data processing, where a service is provided by a person other than the Controller, i.e. a selected Specialist/psychologist/psychotherapist (acting on his or her own behalf and for him- or herself, collaborating with CPHELP under a contract of collaboration), is your consent (Article 6(1)(a) of the GDPR) and Article 9(2)(h) of the GDPR;

    with regard to data provided by you optionally, including but not limited to genetic information, medical information, information about sexuality or sexual orientation, processed for preventive healthcare purposes: informing the patient whether it is possible to provide a service, provide education materials, provide information about health-oriented events, diagnosis, provision of psychological assistance, treatment – the legal basis of processing is Article 9(2)(h) of the GDPR and your consent (Article 6(1)(a) of the GDPR);
    - with regard to Data processed for the purpose of performing the Controller’s statutory obligations, including but not limited to those arising out of tax and accounting laws, in particular to issue an accounting document (e.g. an invoice, a bill, a note) – the legal basis of processing is a legal obligation (Article 6(1)(c) of the GDPR);
    - with regard to Data processed for the purpose of asserting and seeking, or defending against, claims, if any, and Data sent in the contact form as part of your enquiry – the legal basis of processing is the Controller’s legitimate interest (Article 6(1)(f) of the GDPR) of protecting and exercising the Controller’s rights. The legitimate interests pursued by Centrum Psychoterapii HELP involve the ability to demonstrate due performance of services of diagnosis, consultation and psychological or speech therapy carried out, a psychological or speech or learning evaluation drawn up or a certificate issued, as well as the ability to answer a question asked by you in the contact form. Provision of data is voluntary, yet without them we are not able to provide you with the services of Centrum Psychoterapii HELP.

  6. [Recipients] Your personal data are disclosed to the following categories of recipients:
    - individuals entitled under separate regulations to provide healthcare services, Specialists/psychologists/psychotherapists who provide such services at Centrum Psychoterapii HELP,

    entities involved in the processes necessary for the provision of services by the Controller and Specialists/psychologists/psychotherapists, providers responsible for IT system maintenance, entities such as banks and payment operators, entities providing accounting, legal, debt collection services – under a data processing agreement entered into with Centrum Psychoterapii HELP,
    - in case you gave your consent thereto, the data may also be disclosed to other entities for their own purposes, including marketing purposes,
    - where there is a legal basis, your data may also be disclosed to competent entities, bodies and agencies to which the Controller is obliged or authorised to disclose the data under the generally applicable legal regulations,  
    - individuals authorised by you in relation to the exercise of Patient’s rights.  

  7. [Retention Period] The retention period of your personal data depends on the legal basis of the processing:
    - where the data are processed under Article 6(1)(a) of the GDPR, the personal data will be processed until you withdraw your consent,
    - where the data are processed under Article 6(1)(b) of the GDPR, the personal data will be processed until all actual and legal transactions necessary to perform the contract are completed,
    - where the basis for Data processing is the Controller’s legitimate interest (Article 6(1)(f) of the GDPR), the data will be stored by Centrum Psychoterapii HELP until the Controller’s legitimate interests underlying the processing are completed or until you object to the processing. If personal data are processed for the purpose of seeking claims, the data will be processed through the statute of limitations period as prescribed in the Civil Code or other statutes or until the dispute is completed with a non-appealable ruling,
    - where the data are processed for accounting- and tax-related needs, they will be processed for 5 years starting from the end of the calendar year in which the tax obligation arises,
    - where the data are processed for the purposes of promotion and marketing of the business run by Centrum Psychoterapii HELP within the term of a contract, they will be processed until the data subject objects,
    - where the data are processed for the purposes of promotion and marketing of the business run by Centrum Psychoterapii HELP after the termination, expiry or rescission of a Service contract, they will be processed until the data subject withdraws his or her consent.
    After the lapse of the above-mentioned periods, the Data are irreversibly erased or rendered anonymous.

  8. [Rights] The rights you have with regard to personal data protection depend on the legal basis of their processing:
    You always have the right to access and rectify your personal data and to file a complaint with the supervisory authority which is the President of the Personal Data Protection Office in Poland (Prezes Urzędu Ochrony Danych Osobowych). In the relevant cases referred to in the GDPR, you also have the right to request your personal data to be erased and the processing of your personal data to be restricted. The right to request personal data erasure does not apply, among others, to the extent that the processing is necessary for Centrum Psychoterapii HELP to provide you with services. If the data are processed under Article 6(1)(f) of the GDPR, you also have the right to object to the processing. Where the data are processed under Article 6(1)(a) or (b) of the GDPR, you also have the right to transfer your data.

  9. [Profiling] As you use the website https://www.cphelp.pl/, Centrum Psychoterapii HELP may automatically collect and store in server logs technical details about the way you use the services, the requests sent by the user regarding the provision of services in electronic form, the IP address and the technical data about the website operation. They include but are not limited to information about commencing and terminating the use of and the scope of use of each service provided in electronic form. Centrum Psychoterapii HELP may also collect information to store it locally on your device by using the cache of your browser.  

    Where the Controller’s legitimate interest is involved and you gave your consent, your data may be processed automatically, which may involve automated decision-making, including profiling. This is the case where the purpose of marketing and promotion of the Controller’s business is pursued. The data may be then used for profiling in order to address a personalised offer to the data subject. ​
